Throughout this Website, the terms "we", "us", "our" and "Lion" refer to Lion – Beer, Spirits & Wine (NZ) Limited and any of our affiliated companies.

Any personal information or material sent to this Website is subject to our Privacy Policy. The Privacy Policy forms a part of these Terms and Conditions. 

ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION

We are not responsible if the information that we make available on this Website is not accurate or complete. Any reliance upon the material on this Website shall be at your own risk. You agree that it is your responsibility to monitor any changes to the material and the information contained on this Website.

By submitting information, you are also warranting that you own the material/content submitted, that it is not defamatory and that Lion’s use will not violate any third party's rights. Lion is under no obligation to monitor or use the material/content submitted. Lion may delete or remove any material/content that is in breach of these Terms and Conditions.

Unless otherwise indicated, all copyright and other intellectual property rights in all information, data, text, graphics, images, logos, trade marks and other materials on this Website are the property of Lion or are included with the permission of the relevant owner. 

Except as expressly prohibited in relation to particular content, you are permitted to browse this Website, reproduce extracts by way of printing, downloading to a hard disk or for the purposes of distribution to other individuals. This is only to be done on the proviso that you keep intact all copyright and other proprietary notices. No reproduction of any part of this Website may be sold or distributed for commercial gain nor shall it be modified or incorporated in any other work, publication or website.

You are prohibited from doing any act that Lion, in its reasonable discretion, may deem to be inappropriate and/or would be deemed to be an unlawful act or is prohibited by any laws, ordinances, rules, regulations, codes and codes of all regulatory bodies applicable to this Website including but not limited to:

  • any act that would constitute a breach of either the privacy (including uploading personal information without the concerned individual's consent) or any other of the legal rights of individuals;
  • using this Website to defame or libel Lion, its employees or other individuals or acting in such a way that brings into disrepute the good name of Lion ;
  • uploading files that contain viruses that may cause damage to the property of Lion or the property of other individuals.

TERMINATION

We reserve the right to restrict or terminate your access to this Website or any feature of this Website or any feature or part thereof at any time. Any indemnities given by you and limitations on our liability will survive such termination.  Any termination of your right to use or access any part of this Website will not affect any rights which have accrued to or have been accrued by either you or us prior to termination.

SEVERABILITY

If any provision of these Terms and Conditions is held void, unenforceable or illegal, that provision will be severed, and the rest of these Terms and Conditions will have full force and effect.

GOVERNING LAW

You and Lion agree that any controversy or claim arising from or pertaining to the use of this Website shall be governed by the laws of New Zealand. You submit to the non-exclusive jurisdiction of the courts of New Zealand.

FULL TERMS AND CONDITIONS FOR SPEIGHT’S MONTHLY COMPETITIONS PROMOTION

1)    Information on how to enter and prizes form part of these terms and conditions.  By participating, entrants agree to be bound by these terms and conditions.
 
2)    Entry is open to residents of New Zealand who are 18 years and over.  In addition, entrants must be a registered member of the Speight’s website. Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible to enter.
 
3)    The Promoter is Lion, 27 Napier St, Freemans Bay, Auckland 1011.
 

ENTRY

4)    There are four different competition:
 
a)    “Speight’s Perfect Girl” - Entrants must upload a photo of their nominee and explain why they think she is the “Speight’s Perfect Girl”;
b)    “Good Bastard” – Entrants must upload a photo of their nominee and explain why they think he/she is a “Good Bastard”.
c)    “The Pool Room” – Entrants must answer the question stated on the competition entry page (the question will change every month). 
d)    "Cap Quiz Workplace Winner" - Entrants must upload a photo of their nominee and their workplace.
 
(the “Competitions”).
 
5)    To enter, visit www.speights.co.nz, log in to your Speight’s member account (or sign up if you have not already done so), select the particular Competition which you would like to enter and register your details. If you enter the Speight’s Perfect Girl, Good Bastard or Cap Quiz Workplace Winner Competitions, you must also upload additional content, as set out above and on the website, and tick the relevant box to confirm that you have obtained the full prior consent from your nominee to the use of their information, including their image, in accordance with these terms and conditions.
 
6)    Limit of one entry per Competition, per month.
 
7)    The promotion commences on 01/11/2012 and will continue for a period to be determined by the Promoter in its sole discretion. There will be one winner selected/drawn per Competition every month within this period. Entries received up until 23:59pm of the last day of the month will be eligible for that monthly selection/draw.
 
8)    The Promoter reserves the right, at any time, to verify the validity of entries, entrants and nominees (including identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion.
 

ENTRY CRITERIA

9)    Entries for Speight’s Perfect Girl and Good Bastard Competitions must comply with the following terms and conditions to qualify as a valid entry:
 
a)    The entry must be original;
b)    The entry must be in English;
c)    The entry must be submitted by an individual (no group entries will be allowed);
d)    The text entry must be under 500 words in length;
e)    The nominee must be 18 years or over;
f)     The entry must not contain or reference any third party names, logos and/or trade marks, including any third party branded food or beverage products other than Speight’s; and
g)    The entry must not infringe the intellectual property rights of any third party, including, but not limited to, the use of images which are subject to copyright unless you are the copyright owner or have the required permission from the copyright owner.
 
10) Entries will be reviewed for content before being judged; however, such review does not relieve you from responsibility and compliance with these terms and conditions. Entries that do not comply with these terms and conditions or that otherwise contain prohibited, or inappropriate content as determined by the Promoter, in its sole discretion, will be disqualified and will not be considered eligible. The Promoter makes the final determination as to which entries are eligible to take part in the promotion and no correspondence will be entered into.
 
11) When you submit any materials in relation to the promotion, including comments and photographs, (“Content”), you, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content in any media (including the Speight’s website, Flickr and Facebook) for an unlimited period and for any reason (including future promotional, marketing or publicity purposes), without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use, where the moral rights in respect of the Content are yours to assert. You warrant that you have the full authority to grant these rights.
 
12) You agree that you are fully responsible for the Content you submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. Where applicable, you warrant and agree that:
 
a)    you will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
 
b)    you will obtain full prior consent from your nominee to the use of their personal information, including image, in accordance with the uses and terms herein;
 
c)    you will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein;
 
d)    to the best of your knowledge, your nominee does not have a criminal record;
 
e)    your Content shall not contain viruses or cause injury or harm to any person or entity; and
 
f)     you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
 
Without limiting any other terms herein, you agree to indemnify the Promoter against all costs and claims by third parties arising from any breach of these warranties.
 

MONTHLY WINNER SELECTION/DRAW

13) The Promoter will select/draw one winner per Competition from all entries received between 01/11/2012 and 23:59pm on the last day of each month the promotion is open for. This selection/draw will take place within 2 working days of the last entry date for each monthly Competition.
 
14) For the Speight’s Perfect Girl and Good Bastard Competitions, the Promoter’s selection of each winner will be based upon the best entries submitted during the relevant period. To clarify, it is the nominee not the entrant who will be selected as winner. Both text and visual components of the entry will be considered. What constitutes the “best” entry is the sole discretion of the Promoter. For the Speight's Cap Quiz Workplace Winner, the winner will be randomly drawn by the promoter from the entries submitted during the selection month.
 
15) For The Pool Room Competition, the first correct entry drawn from all entries received during the relevant period will be the winner.
 
16) The winners (or the relevant entrant in the case of the Speight’s Perfect Girl and the Good Bastard Competitions) will be notified by email or phone within 7 working days of the relevant selection/draw date.
 
17) Before prizes are awarded to the winners of the Speight’s Perfect Girl, Good Bastard and Speight's Cap Quiz Workplace Winner Competitions, the winners will be contacted by the Promoter to confirm/obtain their consent to the collection and use of their information (including photographs) by the Promoter for the purposes described in these terms and conditions. Contact details (including email address and phone number) for each winner will be provided by their respective nominator. 
 
18) Winners of the Speight’s Perfect Girl, Good Bastard and Speight's Cap Quiz Workplace Winner Competitions and associated material may be subject to promotion and accordingly entrants and/or winners may be required to sign further legal documentation as and in the form reasonably required by the Promoter in its absolute discretion, including but not limited to a legal release and indemnity form, confidentiality agreement and documentation required to conduct a Police Check.
 
19) All winners are subject to verification including complete compliance with these terms and conditions. If attempted notification is returned as undeliverable, if a winner cannot be verified, if a winner (or his/her nominator) does not agree to and sign the further legal documentation as may be required by clause 18, if a winner has a criminal record (including a drink driving conviction), if a winner does not consent to the use of their information as required by clause 17 or if a winner is otherwise unable to accept their status as winner, their selection as a winner will be forfeited and an alternative winner may be selected provided sufficient time remains, in the Promoter’s sole discretion.
 
20) Once the winners have been confirmed, the winners may then be announced to the public on the Speight’s website and the Speight’s Facebook Page.
 
21) The Promoter’s decision is final and binding and no correspondence will be entered into.
 

PRIZES

22) The winners of the Speight’s Perfect Girls Competitions will each receive 2 x 12 packs of Speight’s (the particular variety, including beer and/or cider, is to be determined by the Promoter in its sole discretion) and a $50 Neat Meat voucher.
 
23) The winners of the Good Bastard Competitions will each receive 2 x 12 packs of Speight’s (the particular variety, including beer and/or cider, is to be determined by the Promoter in its sole discretion) and a $50 Neat Meat voucher.
 
24) The winners of the The Pool Room and Speight's Cap Quiz Workplace Winner Competitions will receive the prize as stated on the Competition info webpage (see http://www.speights.co.nz/Win) at the time of entry. The various prizes offered in relation to The Pool Room Competition will be determined by the Promoter in its sole discretion. 
 
25) The prizes are the sole responsibility of the winners.
 
26) The prizes will be couriered to the winners’ addresses within 10-14 working days of being notified.
 
27) Prizes are not transferable and are not redeemable for cash. In the event that any prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value.
 

LIABILITY 

28) All prizes are subject to the terms and conditions of third party supplier, including The Neat Meat Company Limited. The Promoter and its related bodies corporate are not responsible or liable for any direct or indirect loss suffered by any entrant as a direct or indirect result of the conduct of these third parties. 
 
29) The Promoter assumes no responsibility for any failure to receive an entry as a direct or indirect result of a technical problem of any kind or any traffic congestion on the internet or any website.  Entries are deemed to be received at the time of receipt into the competition database, not at the time of transmission by the entrant.  The Promoter assumes no responsibility for, and the entrants release the Promoter from, any loss, claim, damage or injury to person or property (including computer systems and servers) as a result of the participation of the entrants or winners in this promotion or the conduct of this promotion generally.
 
30) Without limiting the foregoing, the Promoter assumes no responsibility for, and the entrants release the Promoter from, any loss, claim, damage or injury to person or property if, for any reason beyond the Promoter's reasonable control (e.g. due to computer viruses, tampering, unauthorised intervention, fraud, technical failures etc), this promotion is not able to be conducted as planned and/or the promotion's administration, security, fairness or integrity are corrupted or affected.  Further, in such circumstances, the Promoter may modify or suspend the promotion and/or invalidate any entries of any individual in any way involved in interfering or tampering with the conduct of the promotion or abusing the communication system upon which the promotion is being conducted.
 

PRIVACY/INFORMATION

31) Details from all entries will be collected and used for the purposes of conducting this promotion (which may include disclosure to third parties for the purpose of processing and conducting the promotion), for publicity purposes surrounding this promotion and any other purpose specified herein (including the use of Content in clause 11). Consent to the use of information as described will be obtained by the Promoter from all entrants when they enter this promotion.

GENERAL

33) The Promoter may at any time, modify, suspend or alter the promotion or any aspect of the promotion without prior notice. Notification of such modifications will be posted on the Speight’s website.
 

FULL TERMS AND CONDITIONS - SPEIGHT'S ALE HOUSE MONTHLY VOUCHER GIVEAWAY
 

1) Information on how to enter and prizes form part of these terms and conditions.  By participating, entrants agree to be bound by these terms and conditions.

2) Entry is open to residents of New Zealand who are 18 years and over.  Employees and their immediate families of the Promoter and its agencies associated with this promotion are ineligible to enter. In addition,

3) The promotion commences on 10/04/2013 and will continue each calendar month for a period to be decided by the Promoter in its sole discretion. There will be one winner drawn every month within this period. Entries received up until 23:59pm on the last day of the month will be eligible for that monthly draw.

4) To enter, visit www.speights.co.nz, log in to your Speight’s member account (or sign up if you have not already done so) and register for the promotion as set out on the website. You will only need to register your details once; further entries can be made by logging in to your already established account.

5) There is a limit of one entry per monthly draw. Each entry is eligible for the prize draw of that month.

MONTHLY PRIZE DRAWS

6) The Promoter will draw one winner from all entries received between 00:01am on the first day of the month (except the first month of the promotion, in which case entry will commence 00:01am on 10/04/2013) and 23:59pm on the last day of the each month the promotion is open for.

7) Each winner will be determined by a random prize draw conducted 2 days after the end of each relevant month. The first valid entry drawn will receive the prize for that monthly draw.

8) Winners will be notified by telephone or email no later than 2 working days after the relevant monthly draw.

9) Each prize consists of a $50 Speight’s Ale House gift voucher. The prize is the sole responsibility of the winner.

GENERAL

10) Prizes are not transferable and are not redeemable for cash.  The judge's decision is final and binding - no correspondence will be entered into. 

11) In the event that any prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value.

12) The prize is subject to the terms and conditions of Speight’s Ale House (including expiry dates and redeemable goods). These can be found on the back of the voucher.

13) Entrants may be refused service of alcohol or provision of an alcoholic beverage prize if it would breach any relevant laws or codes including those relating to the Code of Practice for Responsible Service of Alcohol.

FULL TERMS AND CONDITIONS - SPEIGHT'S GRAB IT PROMOTION TERMS & CONDITIONS 

 
1) Information on how to enter the Speight’s Grab It promotion ("Promotion") and prizes form part of these terms and conditions ("Terms and Conditions"). By participating, entrants agree to be bound by these Terms and Conditions.
 
2) The promoter is Lion, 27 Napier Street, Freemans Bay, Auckland 1011 (the "Promoter").
 

ELIGIBILITY


3) Subject to clause 4, entry into a particular prize draw is open to anyone who, as at its start date, is: 
 
(a) a New Zealand resident; 
(b) 18 years of age or older; and
(c) living in New Zealand.
 
4) Employees of the Promoter and any agency associated with the Promotion, and the immediate families of such employees, are ineligible to enter.
 

ENTRY

 
5) The Promoter will activate numerous prize draws on the Promotion page of the Speight’s website (www.speights.co.nz) (“Promotion Webpage”). When and what prize draws are offered during the Promotion Period will be decided by the Promoter in its sole discretion. 
 
6) You can enter an activated prize draw by visiting the Promotion Webpage, logging in to your Speight’s Mates account (or sign up if you have not already done so), and entering the required details on the registration form . There is an option to share the competition on Facebook.
 

7) The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions (including prize draw details specified on the Speight’s website) or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion.

 

PRIZE DRAWS AND WINNER NOTIFICATION

 
8) When a prize draw is activated, all details (including entry opening and closing dates, draw date, number of winners and prize specifics) will be advised on the Promotion Webpage. Pursuant to clause 1, such information forms part of these terms and conditions which entrants agree to be bound to by participating. 
 
9) The Promoter will select a winner(s) by random draw from all eligible entries submitted between the entry period advised for the particular prize draw. If an entrant wins a prize draw, he/she will no longer be eligible for future prize draws  (unless the winner is forfeited in accordance with clause 12) .
 
10) The winner(s) will be notified by email or phone by no later than 4 days from the relevant draw.
 
11) If a winner cannot be notified or is unable to accept his/her status as winner for any reason, his/her selection as winner will be forfeited and an alternative winner may be selected provided sufficient time remains, in the Promoter's sole discretion.
 

PRIZES

 
12) The prize which is available to be won, including any conditions surrounding its use, for the relevant prize draw will be displayed on the Promotion Webpage. Prizes are the sole responsibility of the winners. 
 
13) The prizes will be couriered to the winners' addresses within 14 working days of being notified.
 
14) Prizes are not transferable and are not redeemable for cash. The Promoter's decision is final and binding - no correspondence will be entered into. 15) The prize may be subject to the terms and conditions of a third party supplier. LIABILITY

 
18) All entrants release and indemnify the Promoter from any and all direct or indirect loss or injury suffered by any person and arising in connection with the Promotion or a prize.
 
19) Entrants must comply with all requirements of the Promoter including requirements specified in the Terms and Conditions. The Promoter may, at its absolute discretion, declare any or all entries made by an entrant invalid if the entrant: 
 
(a) fails to establish their entitlement to enter the Promotion to the Promoter's satisfaction;
(b) tampers with or benefits from any tampering with the entry process or the operation of the Promotion;
(c) submits an entry which in the Promoter's opinion is not in accordance with these Terms and Conditions;
(d) acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person; or
(e) in the opinion of Promoter, engages in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. 
 
20) If for any reason any aspect of the Promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the Promotion, or invalidate any affected entries.
 
21) Except for any liability that cannot be excluded by law, including but not limited to the New Zealand Consumer Guarantees Act 1993, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; or (d) use of a prize.

22) The Promoter may at any time, modify or alter the Promotion or any aspect of the Promotion without prior notice, including entry via Facebook. Notification of such modifications will be posted on the Speight’s website.

SPEIGHT'S CIDER BIG BOT PHOTO PROMOTION TERMS & CONDITIONS

1. Information on how to enter the Speight’s Cider Big Bot Photo promotion ("Promotion") and prizes form part of these terms and conditions ("Terms and Conditions"). By participating, entrants agree to be bound by these Terms and Conditions.

2. The promoter is Lion, 27 Napier Street, Freemans Bay, Auckland 1011 (the "Promoter").

3. The Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. You understand that you are providing your information to the Promoter and not to Facebook. The information you provide will only be used for the purposes of conducting the Promotion (which may include disclosure to third parties for the purpose of processing or conducting the Promotion) and for publicity purposes surrounding the Promotion. By entering the Promotion, entrants consent to the use of their information as described.

ELIGIBILITY

5. Subject to clause 6, entry into any prize draw is open to anyone who, as at its start date, is resident in New Zealand and 18 years of age or older.

ENTRY

7. You can enter the Promotion through the Speight’s Facebook page.

8. To enter, the Big Prize Competition take a photo with your phone (or other camera device) and upload the photo to the Speight’s Facebook Wall.

9. Facebook users who have “liked” or “commented” on the winning photo will automatically be entered into the draw to win to win spot prizes as determined by the Promoter in its sole discretion (“Spot Prize Draw”).

10. Entry is open between on 00:01am on 10/12/2013 and closes 04/01/2014 at 11.59pm inclusive (the Entry Period). No entries will be accepted outside of the Entry Period.

11. Eligible entries for the Big Prize Competition will be judged in accordance to these Terms and Conditions. Successful entrants and associated material will be subject to extensive promotion and accordingly, all entrants warrant that they do not have a criminal record and consent to a Police Check (and agree to complete and file any such necessary documentation) in order to confirm this.

12. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant's identity, age and place of residence) and to disqualify any entrant who submits an entry that is not in accordance with these Terms and Conditions (including prize draw details specified on the Speight’s website) or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion.

13. Entries for the Big Prize Competition must comply with the following Terms and Conditions to qualify as a valid entry:

a. The entry must be original;
b. The entry must include the Speight’s Cider 1.25 PET bottle in the photo;
c. Entries must be submitted by an individual (no group entries will be allowed);
d. The entry must not contain or refer to any third party branded food or beverage products other than Speight’s; it must not contain or reference any third party names, logos and/or trade marks; and
e. The entry must not infringe the intellectual property rights of any third party, including but not limited to the use of images which are subject to copyright, unless you are the copyright owner or have the required permission from the copyright owner.

14. Multiple entries will be permitted subject to the following:

a. entrants cannot submit the same material more than once;
b. each entry must be based on a new idea; and
c. each entry must be submitted separately and in accordance with entry requirements.

15. Entries will be reviewed for content before being judged; however, such review does not relieve you from responsibility and compliance with these Terms and Conditions. Entries that do not comply with these Terms and Conditions or that otherwise contain prohibited, or inappropriate content as determined by the Promoter, in its sole discretion, will be disqualified and will not be considered eligible. The Promoter makes the final determination as to which entries are eligible to take part in the Promotion and no correspondence will be entered into. The Promoter has the right to automatically exclude entries that contain questionable content related to offensive language and/or third party products without further consideration and at its sole discretion.

16. When you submit any materials in relation to the Promotion including comments, (“Content”), you, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use, where the moral rights in respect of the Content are yours to assert. You warrant that you have the full authority to grant these rights.

17. You agree that you are fully responsible for the Content you submit. The Promoter shall not be liable in any way for such Content to the full extent permitted by law. The Promoter may remove any Content without notice for any reason whatsoever. You warrant and agree that:

a. you will not submit any Content that is unlawful or fraudulent, or that the Promoter may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
b. you will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein;
c. your Content shall not contain viruses or cause injury or harm to any person or entity; and
d. you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. Without limiting any other terms herein, you indemnify the Promoter for any breach of the above terms.

18. All entries submitted become the property of the Promoter. As a condition of entering into the Promotion, you license the Promoter and its authorised agents to use your entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. You also warrant to the Promoter that each entry submitted is an original artistic work that does not infringe the rights of any third party. You agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of this warranty.

PRIZE DRAWS AND WINNER NOTIFICATION

19. The Promoter and its authorized agents in their sole discretion will select one winner of the Big Prize Competition from all eligible entries submitted during the Entry Period. The winner will be selected on 6 January 2014.

20. Spot Prize Draws will be conducted randomly during the Entry Period in the Promoter’s sole discretion. Each person may only win one Sport Prize Draw during the Promotion.

21. Winners will be notified within 2 days of the winner selection through the private message function on Facebook. Once the Winners have been notified, the Winners will then be announced to the public on the Speight’s Facebook page.

22. Prizes will be couriered to each winner’s address by 31 January 2014.

23. If a winner cannot be notified or is unable to accept his/her status as winner for any reason, his/her selection as winner will be forfeited and an alternative winner may be selected provided sufficient time remains, in the Promoter's sole discretion.

PRIZES

24. Prizes for the Spot Prize Draws will be selected in the Promoters sole discretion and may include Speight’s merchandise or Icey Tek Chilly Bins. All prizes are valued between approximately $70 and $500. Prizes are the sole responsibility of the winners. 

25. The Big Prize Competition prize consists of a voucher to the value of $1000 for one of the following stores, selected by the winner in his/her sole discretion: Mitre 10 Mega, MacPac, Top Catch, Noel Leeming & Rebel Sport. The prize will be couriered to the winner’s addresses within 14 working days of being notified.

26. Prizes are not transferable and are not redeemable for cash. The Promoter's decision is final and binding - no correspondence will be entered into. In the event that the prize becomes unavailable for reasons beyond the Promoter's control, the Promoter may substitute a prize of equal or greater value.

27. The prize may be subject to the terms and conditions of a third party supplier. If this is the case, the Promoter and its related bodies corporate are not responsible or liable for any direct or indirect loss suffered by any entrant as a direct or indirect result of the conduct of the third party supplier.

18)  The Promoter and its authorised agents will select the winners (“Winners”) based upon the best entries of “much-loved” gear submitted during the Entry Period.

19) The Winners will be selected no later than 23/4/14 by a judging process in which a panel of judges will evaluate each eligible entry and determination of “much-loved” is reserved in its sole discretion.  The Promoter will use all reasonable endeavours to contact the Winners by phone in the first instance. Once the Winners have been notified, the Winners will then be announced to the public on the Speight’s Facebook page and the Speight’s website.

20) Any entrant who is a winner will be notified prior to 23 April 2014. The prize will be couriered to the winner’s address 10-14 days after the winner notifies Speight’s of his/her address.

21) If the winner is unable to be notified (including failure to respond to notification) within a reasonable time after the date of the prize selection, his/her selection as the prize winner will be forfeited and an alternative prize winner may be selected, in the Promoter’s sole discretion.

22) The Promoter’s decision is final and binding and no correspondence will be entered into. The Promoter accepts no responsibility for late or misdirected entries.    
Prizes

23) Prizes consist of replacement of their most-loved (or as close to as possible) Speight’s Polos, Speight’s T-shirt or Speight’s Hat depending on the much-loved item in the photo uploaded. There is a total prize pool of $10,000. Prizes are the sole responsibility of the winner.

24) The prizes will be couriered to the Winner’s address within 10-14 working days of being notified.

25) Entrants must not send their “much-loved” gear to Speight’s. Entrants may deal with their “much loved” gear in their sole discretion.

Eligibility

11) Prizes are not transferable and are not redeemable for cash. In the event that the prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value. 
 
12) The Promoter will select the winner(s) by random draw from all eligible entries submitted during the Entry Period. Winners will be notified by way of email contact.
 
13) The draw will take place on 07/03/16. The first [insert number of prizes] valid entries drawn will receive prizes (each a “Winner”). The Winner(s) will be notified by email from the Promoter no later than 11/03/16.

(b) you will obtain full prior consent from any person who has jointly created or has any rights in the Content, to the uses and terms herein; 
(c) your Content shall not contain viruses or cause injury or harm to any person or entity; and 
(d) you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems. 
Without limiting any other terms herein, you indemnify the Promoter for any breach of the above terms.
 
19) Entries will be reviewed periodically; however, such review does not relieve you from responsibility and compliance with these Terms and Conditions.

Prize and Prize Draw

  1. The prize consists of two (2) tickets to the Highlanders v Chiefs game on the 24th of February at Forsyth Barr Stadium, Dunedin, two (2) Highlanders Hoodies and two (2) beanies worth $250, There is one (1) prize to be won.
  2. The Prize is the sole responsibility of the winner.
  3. The Prize is not transferable and is not redeemable for cash. In the event that the Prize becomes unavailable for reasons beyond the Promoter’s control, the Promoter may substitute a prize of equal or greater value.
  4. The Promoter will select the winner by random draw from all eligible entries submitted during the Entry Period.
  5. The draw will take place on 23rd February 2017. The first valid entry drawn will receive the Prize (each a “ Winner ”). The Promoter will notify the Winner by way of Facebook Messenger by no later than 3pm on 23rd February 2017 and will ask the Winner to claim their prize from the Dunedin Speight’s Alehouse.
  6. If the drawn winner does not make contact within 1 day of notification, has a criminal record, or is found to have otherwise breached any of these Terms and Conditions, his/her selection as a winner may be forfeited and an alternative winner may be selected at the Promoter’s sole discretion. No compensation will be awarded to the forfeiter.

  1. When you submit any materials in relation to the Promotion including comments and images posted in relation to the Promotion on Facebook, (“ Content ”), you, unless the Promoter advises otherwise, license and grant the Promoter, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display such Content for any purpose in any media, without compensation, restriction on use, attribution or liability. You agree not to assert any moral rights in relation to such use, where the moral rights in respect of the Content are yours to assert. You warrant that you have the full authority to grant these rights.
  2. All entries submitted become the property of the Promoter. As a condition of entering into the Promotion, you license the Promoter and its authorised agents to use your entry in any media for an unlimited period for any reason including but not limited to future promotional, marketing or publicity purposes. You also warrant to the Promoter that each entry submitted is an original artistic work that does not infringe the rights of any third party. You agree to indemnify the Promoter against all costs and claims by third parties arising from a breach of these warranties.

    5. your Content shall not contain viruses or cause injury or harm to any person or entity; and
    6. you will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.

Without limiting any other terms herein, you indemnify the Promoter for any breach of the above terms.
